1. Purpose

These Terms of Use (ToU) govern access to and use of the ZeScale platform, an AI-powered visual content generation SaaS service, published by Simeo LLC, whose registered office is located at 30 N Gould St Ste R, Sheridan, WY 82801, USA.

2. Registration and account

Use of the service requires creating an account. The user agrees to provide accurate information and to maintain the confidentiality of their login credentials. Any unauthorised use of the account must be reported immediately.

3. Service description

ZeScale offers AI-powered tools for generating product visuals, UGC videos, virtual models and advertising creatives. The service is accessible via a monthly or annual subscription according to the current pricing plans.

4. Credits and usage

Each plan includes a monthly credit allowance. Unused credits do not roll over to the following month. Abusive or automated use of the service is strictly prohibited.

5. Intellectual property

Content generated via ZeScale belongs to the user. Simeo LLC retains rights over the platform, its algorithms and its AI models. The user grants ZeScale a limited licence to use generated content for service improvement purposes.

6. Acceptable use

The user agrees not to use the service to:

  • Create illegal, defamatory or third-party rights-infringing content
  • Generate pornographic or violent content
  • Attempt to circumvent the technical limits of the service
  • Resell access to the service without authorisation

7. Limitation of liability

ZeScale strives to provide a quality service but does not guarantee uninterrupted operation. In no event shall Simeo LLC be liable for indirect damages arising from use of the service. Liability is limited to the amounts paid by the user over the preceding 12 months.

8. Termination

The user may cancel their subscription at any time from their dashboard. Cancellation takes effect at the end of the current billing period. Simeo LLC reserves the right to suspend or delete an account in the event of a breach of these Terms of Use.

9. Governing law

These Terms of Use are governed by the laws of the State of Wyoming, United States. Any dispute shall be subject to the exclusive jurisdiction of the courts of Sheridan, Wyoming.
